Mark Linnhoefer – They did their time, they took their chances, and now Survivor is rising up to the challenge of their rival. Kim Davis, the Rowan County Clerk who was in prison for not issuing a marriage license to same-sex couples, used the song ‘Eye of the Tiger’ by Survivor during one of Mike Huckabee’s rallies on Tuesday, the same day on which Davis got out of jail.
Mike Huckabee is a GOP presidential candidate who seems to endorse and support the views of Ms. Davis.
The clerk was jailed after she repeatedly refused to comply with orders from the Supreme Court urging her to give marriage licenses to same-sex couples. Her non-compliance has caused a lot of tension and controversy, but not much more. While she was in prison, the first same-sex couple to ever get married in Rowan County got, well… married.
When Davis was released from prison, a crowd of supporters equipped with cardboard signs comparing the Supreme Court to ISIS awaited her, cheering her on. Later, she gave a speech at Huckabee’s rally. A speech introduced by the song ‘Eye of the Tiger’.
Frankie Sullivan and Jim Peterik (guitarist and front-man of Survivor, respectively) are both very pissed at Huckabee and Davis, and it is reported that they might be considering a lawsuit. Sullivan wrote on Twitter that “[the band] did not grant Kim Davis any rights to use ‘My Tune – Eye of the Tiger’”. Peterik tweeted that his “publisher will issue a C&D” as “this [Kim Davis’ homophobia] does not reflect [his] views.”
Sullivan added a “see you real soon” with many “o”s at the end of his tweet, perhaps implying a civil suit, but those are just speculations, of course.
This is not the first time that a rock star has sued a GOP candidate for using their music – just this year, Neil Young made a public statement to Donald Trump for using one of his songs when announcing his presidential bid. In this statement Young only said he was supporting Bernie Sanders, but that should suffice to anger Trump.
Whether Survivor will sue Davis and/or Huckabee remains to be seen, but Sullivan did already sue CBS in 2000 over a show called ‘Survivor’, so it is not that unlikely.
